Mandatory Civil Case Cover Sheets & Summonses
Initiating a formal civil lawsuit in any state court requires more than just drafting a complaint. State rules of civil procedure mandate the concurrent filing of an official Civil Case Cover Sheet and the issuance of a Court Summons.
1. The Purpose of Civil Cover Sheets
Civil case cover sheets are standardized statistical and administrative forms used by court administrators to classify litigation tracks, assign judicial divisions, and determine jury trial demands. Common state forms include:
- California Form CM-010: Civil Case Cover Sheet designating limited vs. unlimited civil jurisdiction, complex litigation status, and tort/contract categories.
- Texas Case Information Sheet: Mandated under Texas Rule of Civil Procedure 78a for all district, county, and statutory probate courts.
- Florida Form 1.997: Civil Cover Sheet specifying remedies sought (monetary vs. nonmonetary) and estimating amount in controversy.
2. Summons Preparation & Clerk Issuance
A summons is the official legal notice commanding the defendant to respond to the lawsuit within the statutory deadline:
- Clerk Seal & Signature: A summons must be submitted to the court clerk for formal signature and seal before it has legal authority to be served.
- Affidavit / Return of Service: Once served by a licensed process server, sheriff, or disinterested adult, the server must execute a formal Return of Service detailing date, time, address, and method of delivery.
